Selling property in Warsaw

Selling a flat in Warsaw comes down to paperwork and timing. I take both off your hands, and you do not need to fly in more than once.

The documents you will need

The land and mortgage register number, the deed by which you acquired the property, and confirmation that the building fees are paid up. If the flat is cooperative ownership rather than freehold, the cooperative issues a certificate that the notary will ask for.

Since 2023 an energy performance certificate is required when selling in Poland. It is quick to obtain and it is my job to make sure it is ordered early rather than the week of the deed.

I collect the list, tell you which items only you can request, and chase the rest.

The tax question

Whether you pay income tax on the sale depends on when you acquired the property and where you are tax resident. Polish law works on a five year rule counted from the end of the year of acquisition, and there are reliefs that can apply.

This is the one topic where I will always send you to an accountant rather than give you a general answer, because the details of your situation decide the outcome. What I do is raise it in the first conversation, so it is not a surprise two weeks before the deed.

If you cannot be in Warsaw

You do not have to be. A power of attorney lets me and the notary work without you, and it can be prepared at a Polish consulate in your country or notarised locally and legalised for use in Poland.

Most foreign owners I work with come to Warsaw once, or not at all. What matters is starting the power of attorney early, because it is the step that takes the longest and the one people leave until last.

How it works

Four stages, and I am present for all of them

01
Price and strategyI look at what actually sold near you, not at what is listed. You get a number and the reasoning behind it.
02
PreparationDocuments, photographs and a listing written for the buyer who will actually pay the most for this particular flat.
03
Viewings and negotiationI arrange, show and filter.
04
Notary and handoverI am there for both. The handover protocol is photographed and the meter readings are recorded.
